Terms of use
These terms of use apply to the FitTune app for iPhone, iPad, and Android and to this website, https://fittune.app (together, the service). Brightpath Labs LLC (we, us) provides the service. By creating an account or using the service, you agree to these terms. The privacy policy explains how we handle your personal data.
The service
FitTune plans strength-training workouts from the goal, experience, schedule, and equipment you give it, and adjusts your next workouts to the sets you log. The app also holds exercise instructions and demonstration videos, and it keeps a history of your training. We may change, add, or remove features as the service develops.
Who can use the service
You must be at least 16 years old to create an account and use the app. If the law where you live sets a higher age for agreeing to these terms, you must have reached that age.
Your account
- You sign in with Apple, with Google, or with a code we send to your email address.
- Keep your email account and your Apple or Google account secure, because anyone who controls them can sign in to your account.
- An account is for one person. Do not share it, and do not create an account for someone else.
- You are responsible for what happens in your account. If you think someone else has used it, write to support@fittune.app.
Acceptable use
When you use the service, do not:
- break the law or anyone else’s rights;
- copy, sell, publish, or share the exercise instructions, videos, or plans outside the app, except where the service lets you;
- decompile or reverse engineer the app, or try to extract its source code, except where the law allows it;
- use bots, scrapers, or other automated means to access the service, or put an unreasonable load on it;
- try to get around the security of the service or reach data that is not yours;
- put unlawful or offensive content, or other people’s personal information, into the text you write in the app, such as custom exercise names and notes.
If you find a security problem, report it privately to support@fittune.app.
Health and safety
FitTune provides fitness programming and education. It does not diagnose, treat, cure, or prevent any disease, and it is not a medical device. It does not give medical advice and does not replace advice from a doctor or another qualified health professional.
- Talk to a doctor before you start a new training program, especially if you have a medical condition, an injury, or pain, if you are pregnant, or if you have not trained for a long time.
- Stop the exercise and get help if you feel pain, dizziness, chest discomfort, or unusual shortness of breath.
- The targets, loads, and rest times in the app are suggestions based on what you tell the app and the sets you log. You decide what you lift. Warm up, use good technique, use collars, safety bars, or a spotter where they apply, and choose a load you can control.
- If a movement causes pain, you can leave that type of movement out of your plan in the app, and you should ask a qualified professional for advice.
- We do not promise any particular result, such as a gain in strength or muscle or a change in body weight.
Strength training carries a risk of injury. To the extent the law allows, you take that risk when you train.
Content and ownership
The service, including its software, design, exercise instructions, videos, and training plans, belongs to Brightpath Labs LLC or its licensors and is protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use the app and its content for your own training, and not for commercial use.
What you put into the app, such as your custom exercises, notes, and workout logs, stays yours. You allow us to store, copy, and process it only to provide the service to you, as the privacy policy describes. If you send us feedback or ideas, we may use them without owing you anything.
App stores
You download the app from the App Store or Google Play, and their terms also apply to the download. These terms are between you and Brightpath Labs LLC, not Apple or Google. Apple and Google are not responsible for the app, its content, or its support.
Ending your use of the service
You can stop using the service at any time and delete your account as the account deletion page describes. We delete the account’s data as the privacy policy describes.
We may suspend or end your access to the service if you break these terms, if the law requires it, or if we stop offering the service. Where it is reasonable, we tell you first and give you a chance to fix the problem. The sections on content and ownership, disclaimers, limits of liability, and governing law continue to apply after your use ends.
Disclaimers
We provide the service as it is and as available. To the extent the law allows, we make no promise that the service will always be available or free of errors, or that it fits a particular purpose.
Limits of liability
To the extent the law allows, Brightpath Labs LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or revenue, that arise from the service. To the extent the law allows, our total liability for any claim about the service is limited to the amount you paid us for the service in the 12 months before the claim.
Nothing in these terms limits liability that the law does not allow us to limit, such as liability for death or personal injury caused by negligence, or for fraud. If you live in the European Union or the United Kingdom, we are also liable as your country’s law requires for damage we cause intentionally or through gross negligence, and you keep your statutory rights as a consumer.
Changes to these terms
We may update these terms. When we do, we update this page. If a change materially affects your rights, we tell you in the app or by email before it takes effect. If you keep using the service after a change takes effect, the updated terms apply. If you do not agree to them, stop using the service and delete your account.
Governing law and disputes
These terms are governed by the laws of the state in the United States where Brightpath Labs LLC is organized, without regard to its conflict of law rules. If you live in the European Union, the United Kingdom, Brazil, Japan, or another country whose consumer laws protect you, you keep the protection of the mandatory laws of your country, and you can bring a claim in the courts where you live.
Before you bring a claim, please write to support@fittune.app, so we can try to resolve the problem with you.
Other terms
If a court finds part of these terms unenforceable, the rest stays in effect. If we do not enforce a part of these terms, we do not give up the right to enforce it later. You may not transfer your rights under these terms to someone else. These terms and the privacy policy are the whole agreement between you and us about the service.
